H1>H4 and then H4 > H1

Hi,

 

I have an H1 visa which is approved and have never traveled to US on that and the girl whom I am about to marry is already in US on an H1 visa. So my question would be will my H1 got cancelled if I traveled to US on H4 after marriage. If not can I get my H4 transferred back to H1 from an organisation once I got a job overseas?

 

Please note I do aslo have an B1/B2 stamped on my passport as well.

If you apply for the H4 visa after Marriage the H1 visa will be stamped CWOP in all likelihood which means you can apply for the H1 visa later on if needed. Once cap counted and in the absence of fraud you are entitled to a total of 6 years in H1 status. Words like canceled etc. have no meaning. Once you come over in H4 status you can have a H1 sponsor file and get a H1 petition approved with COS or not and then start work on approval or with the visa.

You can travel to US on H4 after marriage. Later an employer can file a cap exempt H1B petition with COS from H4 to H1B and on approval you can start working for employer.
