H4 – I797 for children

Hi ,

 

MY H1B Visa expired in Dec 2013. My employer filed for extension in November 2013 and I received documents.

 

I have received I-797A for me (H1B).

 

Received another I-797A for my wife(H4). I did not receive any document for my kid who is 4 years old.

 

My wife and kid are travelling to India next week.

 

Does my kid need I-797 (on his name) for his stamping when he is India?

Does USCIS generate approval (I-797A) notice for kids?

 

Please suggest.

Both your wife and the child need to apply for and get the H4 visa to return.

Your wife and kid needs a copy of your I797 and valid H4 visa to travel to US.
