Situation is : I am in H1B and got my Labor filed in EB2, i been offered by another MNC with L1A Visa. So not sure if i can consider my PD of EB2 filled in H1B to EB1 of L1A... Please clarify ... catx Posted February 11, 2014 Report Share Posted February 11, 2014 If you are or recently have been in the U.S. on a H-1B visa, then you do not qualify for (1) a L-1A visa, and (2) the EB-1C "multinational manager or executive" preference category. For both a L-1A visa and the EB-1C preference category you have to be working for the sponsoring employer outside the U.S. in a manager or executive role for a period of time before you transfer with the employer to work in the U.S. in a similar manager or executive role. In fact there is a possible scenario when someone who has been in the United States for some time in H1B status might qualify to change to L1 status.
