palkipnw Posted February 6, 2014 Report Share Posted February 6, 2014 Hi, I was in H4, then on 2012 one consultant company applied for me H1b that got approved Mar 21st 2013. During that time I was pregnant and could not work for my employer. That time I submitted my maternity leave application to them. But on Apr 22nd 2013 without notifying me, my employer revoked my H1b. This incident I came to know on Oct 2013 and after that I left USA. Again I came back in USA on Dec 2013 with H4 stamping. Now when I'm trying to contact my employer, I found that none of them is responding to my call or e-mails(all emails are bouncing). Looks like they've closed their business. 1. How can I use my already approved H1b? 2. Can I transfer my H1b to another employer? Remember I never worked for them, I was in maternity leave while my H1b got approved. 3. As USCIS status check website is showing - On April 23, 2013, the previous decision made on your case was revoked and we mailed you a notice explaining the decision. Refer 1. 3. No, as by law an employer has to revoke H1B petition once an employee stops working. Link to comment
