L2 working without EAD - urgent please

Hello All,

 

my dependent is working on L2 without EAD(her employer has given the job based on the SSN) .She's been working since 2 years now and has  got the W2's  for all these 2 years. 

 

Now my L1 is getting expired and so my employer is asking me to convert from L1 to H1 and for my dependent L2 to H4. The concern is that when we file the form i539 for change of status , I have to furnish the details of her employment. 

 

Will that be an issue to declare that she is working as she did not had an EAD while working all these years for change into H4. 

 

Please help.

It is complete violation of immigration rule for your spouse to be working on L2 status without a valid EAD. Before she does anything take the help of a good immigration attorney.
