Anshulu
Hi, I work for a big US based company with over 50K employees. My I-140 denied my lawyer said - USCIS doesn't consider my job profile based on the PERM as a "Professional". Plus I have 3 year Bachelor's degree + 3 years master's degree from India. so 3 years bachelor's degree can also be a problem.. My question is -- 1) If the lawyer files amended I-140 under "Skilled Worker" will that resolve the issue of 3 year bachelor's degree? Thanks in advance for your answers!! Link to comment
JoeF
For the "skilled worker" category, a new PERM would be required, i.e., the whole process would have to start from scratch. Link to comment
schintala
Sorry on your situation. What was job requirement mentioned in PERM, that matters for I140 approval. indian 3 year degree can not be equivalent to US bachelors. If your job requirement is Bachelors, even under skilled category could also be a problem. Check with Murthy's attorney for 2nd opinion. Link to comment
Anshulu
Thanks Schintala!! Job requirement was Bachelor's degree or 3 years Bachelor's and 1 year master's degree with 2 year of experience. Link to comment
JoeF
Thanks Schintala!! Job requirement was Bachelor's degree or 3 years Bachelor's and 1 year master's degree with 2 year of experience. That looks too much tailored to you. This kind of stuff is not allowed. Link to comment
