H4 to H1..previously H1 approved

Hi All,

 

 Mine is a different case. Please help me in getting out of this.

 

I worked in India for a reputed MNC. In 2013, my employer filed my H1 and it is approved with validity till  2016.

In the mean time, I got married and my husband is in US. As my employers work place and my husband's work place is different, my employer refused to send me on H1 visa to US. So I resigned and came to US on H4 visa.

My employer didn't share any H1 related documents with me.

 

Please help me in finding answers for blow queries.

 

1) Can I apply again for fresh H1 when he is not sharing info?

 

2) Can I get those documents from my employer by any legal procedure?

 

3)Can I request USCIS for documents?

 

4) Is there any chance of getting information about my approved H1 petition?

1. As your H1B was subject to quota once a new employer can file a cap exempt H1B visa anytime and on approval you can work.
