KarBabu Posted February 2, 2014 Report Share Posted February 2, 2014 My H1 visa is due for expiry in April 2014, Perm was filed on Nov, 2013. All holidays have been recaptured on H1.1. Since my Perm was filed after the 365 day period, I don't qualify for automatic extension. Is my understanding correct ? 2. Considering the delays at DoL, what are my options ? 3. I might be able to work from my company's india office for few months, till the time DoL finishes paper work and then I file for I-140 and I-485 and then get a 3 yrs extension. Is this the only option in my case ? Please share any other suggestions that you might have on this, thanks in advance. Link to comment

Or in Nov 2013, based on PERM pending for more than 365 days employer can file for 1 year extensions. Have some days or few weeks to recapture when employer is ready to file for H1B extension. You can move to H4 (if your spouse is on H1B) a week or two before your 6 years on H1B status. In Nov 2013, if your PERM is still pending employer can file for H1B extension for a year.
