Applying for I140 - Wife COS from H4 to F1

Hello,

 

My wife applied for COS from H4 to F1 very recently. I'm on H1B, recently got labor approved and planning to apply for I140. I remember my lawyer saying that I should include my wife into GC process in I140 stage.

 

Now, If I include my wife in the I140 stage, does it affect her F1 visa approval? (normally COS to F1 takes 3-6 months) 

 

Do I even include her in the I140 stage? Can she join the process in later stages?

Obviously you and your Lawyer are on different pages. Nobody gets added. You mention details of your Marriage in the I-140 and once the dates are current she can apply for AOS to PR.

Sounds reasonable. So, obviously it does not affect the F1 ? Or should I wait until the F1 is approved?

This should not affect the F1 status application.
