IN year 2008 , I moved to H4. I would like to know if we can use remainder time of H1B ( 3+ years ) so that I do not have to go under the cap. Also the employer is going to be different. Also Is there any expiry date for it. I mean can I do the same even in 2020 with the same petition. Your answer is greatly appreciated. Thanks Vamshi Link to comment

Thanks Vamshi A new employer can file a cap exempt H1B petition anytime and on approval you would get 6 years - time spent in US on H1B status. It is possible in 2020 unless immigration rules are changed. Link to comment
