H1B transfer RFE/ E-E relationship

Hi

 

I have recd H1 Transfer RFE and it is related to proving employer employee relationship.

I have multiple layers in between. Employer-Vendor-Vendor-Employee is what I am cuurently involved in.

 

What is the denial ratio in this multiple layer situation. I heard it is quite high. Is that true?

 

What should ensure to include in RFE response to avoid denial in this case? is there any recommendation.

More the layers the tougher the scrutiny is. RFE response has to be done by employer's attorney and not you.

EE relationship doesn't exists in your model, its better to find FTE.

Multiple vendors is pretty much dead.

Employer-employee relationship doesn't exist in such situations.

Find another employer, either FTE or a direct EC, with no vendors in between.
