H1B CAP Exempt date calculation

I have a question with regard to my existing H1-b Cap.

One of the previous Employer filed H1-B for me in April, 2008 and I got approval in October, 2008. My petition was valid from 01-Oct-2008 to 31-Jul-2011. I went for stamping in India on Oct 2009 and I travelled to US and worked there for 3 months (Nov 2009 to Jan 2010) and came back to India.

 

If I have to apply for CAP exempt which date has to be considered for 6 years calculation for applying out of US?

 

Here are the dates mentioned in Petition:

 

H1B Reciept date: 22 April 2008

H1B Notice date: 27 May 2008

Validity : 01 October 2008 to 31 July 2011.

 

Kindly let me know which date has to be considered for 6 year calculation.

Any employer can file a cap exempt H1B petition anytime  and on approval you would still have 5 years and 9 months eligibility to be on h1B status.
