L1b to H1B in April 2014

Hello

 

I am in L1B Visa, Came to USA on Jun 6th 2010, Visa Expiry date is May12, 2015, Current I-94 Expiry date is until Nov 16,2016. I have below questions.

 

1) Since my new I-94 is until Nov16th, 2016, Can i stay until Nov 2016?

2) I am planning to apply for New H1B( i.e. L1 to H1B)  by next April 2014 with the new employeer B, Will I counter restart and whether i can stay for next 6 years in H1b?

3)  Say my H1B is approved by june or july, If i was sent back to India by May 2014 or between April 2014 to Oct1st 2014 by my Current Employeer A, Is it possible to get H1b Stamped and come back to USA for my new Employeer?

4) What are the documents i need from my new Employeer to go for H1b Stamping?

1) On L1b  maximum stay is 5 years.You can recapture the period you were not in this country.

2) No.L1 stay is counted.

3) Yes , provided he has the job for you.

4) I797 , client letter , educational and other relevant documents.

1. 5 years on L1B status is maximum allowed.

2. Nope. You will get 6 years - years spent on L1B.

3. Yes.

4. Employer's attorney would advise you. Basically I129 with LCA, I797, client letter, offer letter, etc.
