Need advice on green card processing

Hi,

 

I am working with a company A and my h1 is getting expired in August 2016.

Due to layoffs in my current company, they can't file the labour. I am exploring an option of to file a labour from a future employer B, which can file my labour and I-140 (most likely I am going to joined new company B but there are chances that I many not join).

 

My questions are

1. Is it possible for company B to file my I-140 before I join?

2. If its possible then can my company A use this I-140 to extend my visa?

3. In case if I never join company B then what could be the problem in green card processing?

 

Please advice me.

1. Yes.

2. If I-140 is not revoked by company B then yes.

3. They might revoke I140 after approval and then you need to start GC process from scratch. Only advantage is you can port the priority date.
