H1B Denied, Filed an MTR

I applied for a fresh HIB  visa for the very fisrt time this year. and it got selected in the lottery.My present status is  H4. I got 2 RFE'S since April and my employer responded back to both the RFE'S in time. But then i got my visa denied on thursday.I would really appreciate if you could answer my following mentioned below question, it will be of great help to me-

1) My employer is ready to file an appeal or MTR for my case. What is the diffrence between appeal and MTR.And if i have both the options which one should i go for.

2) What are the chances of getting my visa approved. I know this question is difficult to answer but based on your experience.

3) How much time does an appeal or MTR takes to give the final decision.

4) Also after filing the appeal or MTR, can i travel to India and meet my family on my present H4 visa. Is it advisable or will i have to stay in US only till the time i get my results.

5) After filing an appeal or MTR will my case be reviewed by the same uscis person who gave the decision on my visa or it will go to an entirely diffrent person.

Your quick response is highly appreciated since i have very less time to take the decison. Thanks so much in advance.

2 RFEs!!! First let us know the what were the RFEs about and reason for denial?

1) Appeal takes longer according to uscis current processing time is 6 months or less, MTR is 90 days (although i know people who are waiting longer). Go for MTR to save time, appeal is too long.

 

2) I have seen success cases, its all upto your documentation, a good lawyer to support your case against the RFE issued.

 

3)1- 6 months typically

 

4)Dont know

 

5) Same person, tahts why you need to make sure your evidences can turn this case around and prove him wrong on his denial.
