Soni19 Posted November 18, 2013 Report Posted November 18, 2013 Hi Friends, My situation: I am in US on L2 visa (passport stamped). I had applied for H1B for 2013 and got approved. I have a baby of 2 months now and really can't do job... I want to go back to L2 visa, so that I can stay with husband (he has L1B) in US and take care of baby for at least 1 year. Problem: I do not have any paycheck till date, my employer is not giving me, (They asking me to clear interview in market and get Work Order for him) 1. Please advice what should I do? 2. I want to revoke my H1B and go back to L2. 3. what is process to change from H1B to L2. I am really in trouble. Pls help.. Thanks in advance

File a complaint against employer with DOL for not paying you. Whether project is available or not employer has to pay you on H1B. Otherwise you are out of status. Filing a complaint is the only thing that is going to help you.

You knew you were pregnant at filing time in April 2013 and were unlikely to use the H1B this year. File for COS to L2 or exit and reenter on L2 stamping. File to get pay if you reported for work on Oct. 1. I hope you took formal maternity leave so as to preserve your status if you did not report for work.

If I ask my company to cancel H1B and I file COS from H1 to L2. how much time it will take? my Husband's L1B is going to expire on 30Jan, 2014. his company is going to apply for L1B extension in first week of Jan, 2014. Pls advice. A minimum of 4 months based on current processing times.
