Visiting on B1 and Convert to H1 ( with cap exemption)

Dear Immigration Experts,

 

Greetings to you all...!!!

 

Humble request to help me in taking decision.

 

 

I am having Approved H1B ( i797) in hand which is expired in August 2012. I did not used this not even a single time.So I can use this petition for H1B Cap Exemption.

 

Now I got a call from one employer and they want to have a Face to face discussion on Project plans and time lines . Once I got success in discussion, i need to work almost independently on the project.

 

Now my employer/client is telling that we will issue a invitation for B1 Visa. On your arrival in USA we will discuss and once we are happy then we will apply for H1 with premium processing.( under Cap Exemption)

 

My Question is: Can I go to US on B1/B2 Visa and covert it to H1B. Will this works? or there are any hidden problems in doing so, Please give me your inputs.

Permitted B1 activities are different from H1B activities. Check with an attorney about your plans to make sure you will not be involved in improper B1 activities.
