Hi,

 

I am in India and I have company sponsored valid H1B. As of now there is no onsite opportunity in my project.

So, can I travel to U.S. without informing my company and join some other company in U.S. The company in U.S. inform me that it will do all the formalities that are require so that I can work here without a fuss.

 

Please let me know your inputs on this.

You can NOT enter on the H1 for the other company. That would be immigration fraud, which could result in a lifelong ban for you.

The new employer needs to file an H1 for you. When that is approved, you can enter with the approval notice.

Yes, you can provided the company in US has already filed a cap exempt H1B petition and had obtained I797 approval notice.

That's ILLEGAL, moreover you need company's 797 and employment letter at POE.

Tell your new employer to file H1 and enter with new 797.
