I want to know the full process and timeline. From what I read so far, there are 2 ways to sponsor them 1) File I-130 (when they are not in US) - How long does this typically take to approve? - Once I-130 is approved, do they get interview call right away? - Can they travel to US on visitor visa while I-130 is pending? 2) File I-130 & I485 together (when they are in US) - They are in AOS right away. - How long does it take for I130 and I485 to get approved? - There is no interview needed, correct? t75 Posted November 17, 2013 Report Posted November 17, 2013 You cannot sponsor for citizenship - only permanent residency. It does not matter how long it takes; they cannot enter the US on visit visa once they have "immigrant intent". You have posted that you intend to file for them on a public forum. You should already know that any entry into the US on B2 visa by your parents requires that they lie about their plans and is against the rules. As a US citizen, you are required to follow ALL of the laws even those you find personally inconvenient. If you don't like the laws, you should not have come to the US. People who make plans like you have are the reason family members have difficulty obtaining B2 visas. Read the USCIS documents on consular processing. That is the only option for their processing to LPR status.
pontevecchio Posted November 17, 2013 Report Posted November 17, 2013 1. The Consular route takes about an year. Travel during the process is not advised though YMMV. 2. The AOS route takes about 6 months. Any Interview should not be a problem even if that would be rare. The speed depends on your ability to provide specific documents or their equivalents. Birth Certificates etc..
