DUI and deported for employer-employee relation

I am posting behalf of a friend . Please do reply

With any suggestions

My friend got deported this year at Chicago airport

The officer initially while taking him into the room

Talked about his DUi which made him nervous and

In turn he did not answer employee-employer relation questions

Well and they rejected based on employer-employee

Relation. We came to know from lawyer that they cannot deport

Based on DUI so we are suspecting that they made my friend nervous

By talking about DUI and therefore making him to fail to answer

Employer- employee relation.

However now he has a H-1 with new employer and he has a client

Offer letter and he is going to stamping in India. Any suggestions/inputs

On what he should expect or be prepared at the visa interview in India considering his background

a DUI scenario please post what to expect and how to handle

If your friend became nervous during questioning about his past conduct so that he could not answer questions, the immigration inspector was very right in denying him entry. No non-citizen is guaranteed entry into the US.  Anyone who is so irresponsible as to drink and drive in the US is certainly suspect as to his/her intentions. It is too bad that the US does not treat DUIs as Canada does.

 

Your friend was denied entry based on his own conduct. Quit trying to defend him.

 

As for "handling", he needs to tell the truth. He may be granted a visa but then again he may not. Obviously, his new employer did not conduct a background check before making employment offer.

As for DUI, I don't think it might have an impact at the visa stamping. But I suggest it would be worth contacting one of the Immigration attorneys and seek their opinon if at all DUI conversation comes up at the visa stamping.

I got a DUI and changed employer and went to india, went thru  medical evaluation, got the h1b  visa stamped, simple interview; but i did mentioned in my form that i had a dui;

at poe they took me for screening and told me that everytime i comeback to usa i will go thru secondary screening at poe

Obviously one needs to understand that a DUI does not make someone ineligible to work for rest of his/her life; Obviously smart people are making hiring decisions
