I did not fill the I9 or I9 and dont have an SSN. I came back to India within a week. Does this anyway violate the US rules? The new employer who got the project is asking me to join him and is ready to initiate a H1 transfer, Is it good to join him? The new employer says he will give a letter so that I can travel US immediately on his behalf and apply for transfer once I reach US. I am not convinced about this Please help me to clarify the above queries Thanks Srikar

DO NOT ENTER US without an approved I797 from new employer. If they are that desperate they could file your cap exempt H1B petition on premium processing and get approval within 15 calendar days. If new employer insists so then start looking for another genuine employer.
t75 Posted November 15, 2013 Report Posted November 15, 2013 Do NOT travel until you have approval notice from new employer. Trying to enter on old employer and then having transfer filing is NOT an option. Find a new employer who does not ask you to violate US immigration rules.
