L2EADGC Posted November 15, 2013 Report Posted November 15, 2013 Hi, I'm currently in USA on H4 and I got old approved H1B petition that was filed in 2006 as Consular Processing and I never went for stamping or used that petition. I was in USA on L1A for 7 years and spent more than 365 days continously outside since 2012, I would like to know if my old H1B can be used to file a CAP Exempt case for me . I currently have the job offer and need to know if its possible as cap exempt ?
