Right now my H1B is in RFE stage and they employer is telling me that employment agreement is necessary to work upon the RFE. My question is if I do not want to continue with them, can I do change of status to B2 while I find another job? In short, can COS to B2 be filed when H1B is in RFE stage?

Is this your first cap subject H1B or a cap exempt H1B transfer with a new employer?
