pontevecchio Posted November 15, 2013 Report Posted November 15, 2013 The fact that the I94 was issued means you have no worries.
ksgvarma Posted November 18, 2013 Author Report Posted November 18, 2013 But H1b is not continous .., that means ur are unlawful to stay in US during that period
jairichi Posted November 18, 2013 Report Posted November 18, 2013 But H1b is not continous .., that means ur are unlawful to stay in US during that period You could ask your attorney to clarify with USCIS regarding this.
pontevecchio Posted November 18, 2013 Report Posted November 18, 2013 There is no problem since the new I94 has been issued. You will be considered never out of status or in unlawful status.
itsmeusa Posted November 18, 2013 Report Posted November 18, 2013 Hi ksgvarma - I had about 1.5 years of gap on the approved I-94. But that didn't stop me from getting 2 H-1b extension approved, I-140 approved after it happened. I asked my lawyer about this gap and her take was as long as I have the proof that H-1b was filed in time, I am all set. And truly, that gap was never came up...
