kpl_cpl Posted November 14, 2013 Report Posted November 14, 2013 Hi Out of my H1B 6 years, only 2 months are left. As the company did not file for GC, I went to India to wait for 1 year gap. But I cound not make it through the lottery. So, I am checking my options with the old H1B. Is it possible to start my GC processing, starting PERM Labor being in India either through old company or new employer? In that way, if PERM and I-140 are approved, can I get extension of the old H1B? I am not sure if I can make it through the next year's lottery for fresh H1B. I would appreciate your advise. Thanks
t75 Posted November 15, 2013 Report Posted November 15, 2013 A person need not be in the US for PERM. You can get extension. If your old company would not file when you were working for them, why would they do so now? Why would a new employer file if they had not evaluated your work?
