She has to return back India for family reason and will not be able to back USA at least 2 years. I am trying to file re-entry permit and have few questions. Can you please help on this. 1. What are the list of documents required? Remember, She is 11 years old and I (Parent) will still stay in USA.2. From USCIS website I basically determined it to be 1. Copy of Green Card (front and back) & 2. Copy of I-551 (front and back). I am confused, what is I-551? 3. Do I need to provide any logical reason to get re-permit for her? If yes, where should I have to mention this reason?
catx Posted November 14, 2013 Report Posted November 14, 2013 One important note: A reentry permit is only valid for up to 2 years maximum. If the stay outside the U.S. is longer than 2 years, then it will deemed that the person has abandoned their permanent residency. Since you stated that your daughter will not be able to be back in the U.S. for at least 2 years you should consult with a qualified, experienced immigration attorney. (It is also worth noting that as options it would be relatively easy to get your daughter (new) permanent residency if was still a dependent (less than 21 years old), and she may even qualify for and be able to get a Returning Resident (SB-1) visa. These options should be part of a cosultation a immigration attorney.)
