STEM Extension, when applied for graduation after OPT expires. Need Help!!

Hi,

 

I am on 12 months OPT now, I completed my graduation requirements in May 2013 and My graduation was denied because my professor missed to submit one of my grades (which was extra credit course) . I corrected my grades and reapplied for graduation date change, by then then deadline for Dec 2013 graduation had passed (by 1 week). So my graduation date now says Spring 2014 (May 2014).

 

My OPT expires on Feb 9th 2014, My College DOA asked me to apply for STEM extension in early January so that i will get sometime till it process and if USCIS asks for proof of degree completion it will buy me some more time. My i-20 says that I have completed my course work and also a letter from my department that i am ready to graduate. I am constantly asking my University to advance my graduation date to Dec 2013, since i dont want to take risk with USCIS.

 

I have many questions in my case.

 

1. Advisor said that STEM Extension it gets denied, since my EAD will be expired by then, I might have to leave country immediately. Is it true? I heard that we will get 60 days grace period.

2. After it is denied can I apply for Motion to re-open/ Reconsider?

3. Can I send letter from department saying that I have completed all the requirements for graduation? And USCIS will consider it?

4. My company will apply my H1B visa on April 2014, I know I cannot stay if my STEM gets denied and Visa is approved until Oct 2014. Can I re-enter once my Visa is stamped?

5. What are my other options if it gets denied?

6. Can I take any legal actions, since it was not mistake that graduation was denied and I did not receive any letter from university which they had mentioned on website upon graduation denial ( Please wait till you receive letter from university before contacting the office)?

7. what if I get married now and after denial will I automatically fall on dependent visa? If my spouse is on STEM and H1B processing, or Do i need to go back and get the stamping?

 

Please help me with my doubts so that I am prepared well in advance.
