lvppro Posted November 13, 2013 Report Posted November 13, 2013 Hello experts, I am currently with Company A which has filed green card in both EB3 and EB2. I have I -140 approved under both category with PD: Oct 2010 (EB3), June 2013 (EB2). Also, my H1 visa based on EB3 is up for renewal in March 2014. Can I change my company to Company B? I know Company B needs to start over the green card process all over again. I am hoping that after I get I140 approval with company B, they will be retain PD of Company A. My company will not give me a copy of I140 approval to me. so, I am not sure if that matters for Company B when they apply for greencard and try to maintain previous priority date? Do you think it is risky to change job at this time? Please help?
Belle Posted November 13, 2013 Report Posted November 13, 2013 Yes, you can change jobs and extend H1. Get a consultation with a lawyer. The lawyer should be able to advise which I-140 you are better off using for the extention, and how you can demostrate you had an earlier PD. This does not seem to be problematic.

If I join Company B when I only have 4 months of H1-B remaining on greencard extension, when company B apply for H1-Renewal (and H1 - Transfer), will they get H1 for next 3 years or just until March 2014? If they get until March 2014 only, I dont believe company B will have time enough time to apply for Greencard
