If your spouse is on H1B you can apply for a H4 visa. But, once you enter US on a H4 visa and if you would like to begin work an employer has to file a COS to H1B.

When you are ready to begin work the employer has to file a cap exempt H1B petition anytime of the year and on approval you can begin to work immediately.
