H1 to H4 Tranffer - Process

Hi All ,

 

I am going to change my visa status from H1 to H4.

Now problem is when I was working on H1b, my husband H1b got extention but we havn't appiled for my H4 extention as I was on H1b .My h1b is valid till jan 2014.

 

Now i am going to india for stamping and while coming back i need to come on H4.

 

Can any one please suggest what is legal process for tranffering H1 to H4. My husband's employer is confused and not telling any proper way to do so.

If your travel to India is soon then you can apply for a H4 visa and enter US to be on H4 status. For a visa interview you would need a copy of your spouse's I797. If your travel is delayed then you need to apply to USCIS by sending I539 form and supporting documents.

If you travel to India now and do not have a valid H4 visa in your passport you need to apply for a H4 visa at US consulate with a copy of H1B documents from your spouse.
