Soni19 Posted November 12, 2013 Report Posted November 12, 2013 I am working on L2 EAD valid till Feb 2014.But applied H1B visa in April 2013.And It got approved.But in The mean while went for Maternity leave for 3 months Aug ,Sep Oct.Now Joined Company who applied for H1B in Nov.And searching for Job.1) But I don`t want H1B now and want to back on L2 waht are the options?2 ) If I go to India in Dec 2013 and come can I use my L2 visa valid till 8 Feb 2014 or need to go for stamping ?3) If I will go for stamping do they cancel me L2 visa too if H1B rejected ?

Otherwise you are out of status. To go back to L2 you need to file for a COS from H1B to L2 or exit and enter US on L2 visa. There is a possibility that they might cancel your L2 visa when you go for H1B stamping. I am not 100% sure about this.
