rajendrabujji Posted November 12, 2013 Report Posted November 12, 2013 Hi My H1B expires on July 2015. My company says they apply GC soon. If they apply GC early 2014, 1) Is this time sufficient? 2) how much time usually required to get Labor approved and I140 approved? 3) If my Labor not approved with in July 2014( one year before) and approved some where around 2014 august, do I get my 1 year extension on H1B?
irarum Posted November 13, 2013 Report Posted November 13, 2013 1. Yes 2. about 6-8 months for PERM (assuming no audit) from the day applied. 140 can be applied in premium and if no RFEs you can get a decision in 15 days. 3. A PERM pending decision for 365 days or PERM approved & 140 decision awaiting but 1 yr spent since PERM applied date qualify for extension of 1 yr. Start pushing your company to file for PERM or look for another employer who can do it right away. Good luck. Make hay while sun shines.
