My company has initiated GC for me under EB3 with PERM being filed on September 5th. Since current trend of PERM approval is 9-10 months and this is falling outside my H end date, what are my options to stay in usa. Any suggestions on this is appreciable Thanks.
JoeF Posted November 12, 2013 Report Posted November 12, 2013 You would have to leave the country, or, if you are married and your spouse is on H1, you can change to H4.
Oblesh Posted November 12, 2013 Report Posted November 12, 2013 Explain your story clearly, Is your extension filed after six years? if yes you have to calculate howmuch time your were outside of the US in that six years. you can get extension for that period, talk to your attorney clearly and explain.

My PERM was applied on September 5th... with current trend the PERM approval period is 9-10 months, that's taking me past the Visa end date... So which is advisable... 1. Stay till March 30 and go india and come bak to usa wen PERM is approved 2. Go to India in december, then apply extension for 3 months + 40 days from March 31 and come bak then
