visa140perm Posted November 11, 2013 Report Posted November 11, 2013 Hi Guys I have an approved I-140 from my previous employer. I moved to a new company and using my old I-140, I got a three year extension. Now, my new employer has filed for my PERM. However, in the PERM questionnaire, I did not see anything which indicated that I am filing in EB2 category and I want my priority date ported. My lawyer said that the process for keeping the old priority date is usually done only at the I-140 stage and not while applying for PERM. But, when I see the entries posted in trackit.com, many people have entered comments saying that their PERM case was audited for EB3 to EB2 reason. But, as my attorney is saying that this process is only done at I-140 stage, I am confused. Please help. Thanks.
pontevecchio Posted November 11, 2013 Report Posted November 11, 2013 EB2/EB3 is based on the job requirements and your credentials and is allocated at the time of I-140 approval.
