L1B to Green Card/H1B

HI,

 

My  L1B visa expired already on Jan 2012, but I have Valid I-94 till August 16 2014. I'm in US since 2009 August without any break. Twice I had vacation to India and around 40 days I was out of US during my stay. Now, my current employer(L1B visa sponsor) is trying to extend my stay in US.

 

1,  Am I eligible for green card? Can my company apply for Green card?

2, If they apply for Green Card how long will it take?

3, In case if my employer apply H1B in April 2014, do I need to stay out of country between August 2014 to October 2014?

4, I never been Manager. Is it advisable to apply L1A  ?

 

Please advice.

1. Of course you are eligible for GC.

2. It depends in what category they file your GC??

2, How long does normally take to clear my labour? is there any premier process?

3, is there any possibly to clear my labour before my I-94?

1. That's fine, all you need is legal status. VISA is only required when you enter into US

2. Not sure may be 6 months

1) Yes, you need to have a valid visa.

 

2) no premium for labour, i generally takes around >1 yr

 

3) Not really, even if your perm is approved, you will still need a visa.
