spjay20 Posted November 11, 2013 Report Posted November 11, 2013 HI, My L1B visa expired already on Jan 2012, but I have Valid I-94 till August 16 2014. I'm in US since 2009 August without any break. Twice I had vacation to India and around 40 days I was out of US during my stay. Now, my current employer(L1B visa sponsor) is trying to extend my stay in US. 1, Am I eligible for green card? Can my company apply for Green card? 2, If they apply for Green Card how long will it take? 3, In case if my employer apply H1B in April 2014, do I need to stay out of country between August 2014 to October 2014? 4, I never been Manager. Is it advisable to apply L1A ? Please advice. Thanks in advance.

rohang Posted January 15, 2014 Report Posted January 15, 2014 1) Yes, you need to have a valid visa. 2) no premium for labour, i generally takes around >1 yr 3) Not really, even if your perm is approved, you will still need a visa.
