USAVISAH1B Posted October 31, 2013 Report Posted October 31, 2013 Experts I need your advice. I am currently on H1b with employer A. My H1b started this year in October and I went to Canada for my stamping and I am back in the US. I have a FT offer with company B and my start date with them would be Jan 6th 2014. I wanted to go to India in december 2013 on vacation. Company B wants to start my H1b transfer now, they say after the H1b is transferd over to them I can go to India and come back. I am worried that at POE they might question me about my employment...I am asking them to start the H1b transfer after I come back from India but HR is insisting and says there is no issue for my travel after the transfer and even after the transfer I can be working for my current employer till Jan 6th is this true?

Yes, what they said is true. Even if employer B's H1B petition is approved it is you who decide which employer's I797 you are going to present to immigration officer at POE and request for admission in to US. Nothing to worry.
