jacinto7 Posted October 30, 2013 Report Posted October 30, 2013 Hi, I am on an H1b and plan to get married in the following months. The main thing is that I want to quit my job, get married and then have the option to work in the future. Is it ok for me to quit my job, get married within a month and then stay in the country? Thanks, Jacinto
pontevecchio Posted October 31, 2013 Report Posted October 31, 2013 It is OK to FIRST get married and then have your AOS on file and then move on with your life. Also keep a Lawyer involved.
jacinto7 Posted December 9, 2013 Author Report Posted December 9, 2013 is there any chance that I can quit first and then do the AOS? I can't stand my job anymore and getting married will be in a few months. My job is extremely abusing and i am desperate to quit. Thanks
catx Posted December 9, 2013 Report Posted December 9, 2013 If you quit your job while on a H-1B visa without some other valid visa, then you will be out of status (in the U.S. illegally). On a H-1B visa your status is conditional on you working for your sponsoring employer. Further, based on what you posted, the USCIS may well closely scrutinize your marriage to make sure it is not for immigration benefit. You and your finance should consult with a qualified, experienced immigration attorney to understand your options before taking any actions and help you with the immigration processes.
t75 Posted December 9, 2013 Report Posted December 9, 2013 You can go home or try to change to B2. However, B2 does not permit immigrant intent.
