H1 transfer in 7th year to new employer to file new perm option

Hi Experts,

 

My PD is Jan 2013
current status:Audit

I am currenlty in 6th year and my H1 is valid till Feb2014.
I am looking for advice/guidance from experts on same questions

1.Will I be able to change employer at this point of time, Can a new emp apply my H1 Extn/transfer considering that I have applied for GC before 1 yr term with the previous employer..

2.I am looking for options incase my labor is not approved after audit.

3.If I get 7th year extension approval with current employer, Can i transfer to new employer to apply for new perm incase current perm with current employer not approved

Please guide me the options

1. yes you will get ext for only one year based on pending PERM.

2. Better to apply for your H1B ext with current employer while PERM is pending and this will give you status for an extra year.

3. Sure. But ask your new employer to file for PERM and LCA at the same time before you can join them.

 

Do you I140 in PP if you job is pretty good and related to your qualificaions. this will releive you from stressinf out every 6 months bcoz you have apply for transfer if not approved in proper period plus adds cost to your employe and also you if you PP every time you apply for H1B ext.
