Hi

 

I am planning to apply for Change of Status from H1B to F1. My H1 is valid till 2015 but I will be starting school from Jan 2014 and plan to file COS ASAp. I am aware that the processing time for COS may be long. My question is that if time comes for my school to start, can I resign and start school on a pending Change of status application ? I will have pay stubs etc to show that I was working even after filing change of status.

I doubt university will allow you to attend class just based on receipt notice unless you can submit an approval notice in a week or so. If you want to join a university with no issues just leave and enter US with a F1 visa.

You can start school with a pending COS from H1 to F1. This is only limited for some statuses, like B2, or F2, where the COS has to be approved before the person can start school. For COS from H1 to F1, that's not an issue.

You can go to school when you are on H1. So no need to resign before the F1 approval.

But make sure you stop working after the F1 approval.

Thank you all for answering. I will then apply for cos and use the cos receipt to join school in jan 2nd week. But I will be unable to start studying without resigning. So i have to resign. But my resignation will be after applying for cos (I will have pay stubs) and my last working day will be within 30 days of my i20 date. Do you think this is all or is there anything else that needs to be considered?

@rahul412 : I cannot tell my job that I will be a student but you have to keep paying me. So I need to resign from there. Did I understand your question correctly ?

Guys - I have one more problem and need your comments. I am joining a doctoral program with financial aid. Suppose my COS to F1 is not approved by the time I start school, do I need to pay tuition to begin school. I know this depends from school to school but I want to know if there is someone who has faced a similar situation. Do you guys have any thoughts on this ?

I am not exactly sure how things work during the COS from H1 to F1. If you can work during the COS period then you are good to go, work till your COS is approved and resign and moreover you can go to school on H1, so you should be fine.
