Should I get the stamping done in India?

Hello All,

 

My H1B stamped visa is valid until 30 Nov 2013 and I return to US on 16 Nov 2013. I have my H1 B extension ( I797) with me.

 

My question, since I will still have a current and valid stampin on my passport when I enter, will I be OK or should I still set up a visa interview while I will be in India?

 

Any input would be welcome.

You should be fine to travel with your unexpired H1B visa and extension approval notice.

I am not sure if you will get I 94 as per new petition expiry date. There is a lot of confusion on this. Find out and know clearly. Because if POE officer does not give I 94 till new I 797 expiry and gives you only as per current visa stamping date i.e. 30 Nov 2013, you have to go out of country and get stamping done and come back.

Date in I94 is mostly based on petition expiry date or date of expiry of passport.
