H1 B transfer without i 797 + paystub +i94

Compant A filed my h1B cos from l1.They are not able to find any project for me. I got a full time job from company B.

 

Company B lawyer is asking for my H1 B documents which is not with me.My current employer is not providing me any documents I 797,I 94. I have EAC # and i am pretty confident that belongs to me. As i am in the first month of H1 b approval , i do not have paystub .

 

 Can I file for a H1B transfer( i understand that would be filing new h1 under cap except) thru' company-B with just the receipt number? Company B lawyer is asking for any documentation that can prove that EAC # belongs to me.

 

What are my options here ?

My H1B started Oct-1st 2013 and the company-A is on monthly payroll.

Well, you could file a FOIA to get a copy of your H1B documents from USCIS.
