arya1985 Posted October 27, 2013 Report Posted October 27, 2013 I'm Planning to go for H1B Stamping to Canada next month.(DEC) Can i use the AVR rule in case i receive 221g/visa not stamped. My case: I came to US on F1 visa during 2008. 2010 I finished my MS and got OPT valid till Jun 2013. I applied for H1B visa by Apr 2013 and got approved till 2016. Right now My F1 Visa got Expired (Jul 2013). Can I go to Canada for H1B Stamping and return back to US if in case I receive 221g slip/visa not stamped. Please Advice.
pontevecchio Posted October 27, 2013 Report Posted October 27, 2013 This is the only exception to AVR. If you do not get a H1 visa you cannot return.

AVR is not applicable if you have attended VISA interview in Canada. If that's the case, then everyone will go to Canada and visa interview doesn't make ANY SENSE.
deeparmani Posted November 5, 2013 Report Posted November 5, 2013 Ok I am curious , why do people go to canada for visa stamping? there is avr rule if we visit canada or mexico... is it because visa stamping is difficult in India .. Or i simply do not understand the reason to travel to canada for visa stamping. explain please
pontevecchio Posted November 5, 2013 Report Posted November 5, 2013 Usually it should be convenience. A mistaken impression that the same American Visa Officer would make different decisions in different countries.
