Krishna_V Posted October 26, 2013 Report Posted October 26, 2013 Hello, Please help me with below questions - 1. Do I need to stay "physically" in USA during all of these : PERM process, I-140 and H1 extension? Or could I enter USA after visa interview (with PERM, I-140 and H1 approval) 2. Say suppose my PERM is approved and I had to move out of USA after my 6th year H1B. Then can I enter USA right after I-140 & H1 approval with stamping? any criteria/conditions/restrictions? 3. Is h1b stamping safe in India with just 2 months left on 6th year of H1B (though you are working as FTE for a US employer) - this is to recapture some h1 time Thank you
rahul412 Posted October 27, 2013 Report Posted October 27, 2013 GC is for future employment, that means a person can or cannot be present in US physically during the GC process.
Krishna_V Posted October 28, 2013 Author Report Posted October 28, 2013 Thanks Rahul! If we are already an FT employee (primarily to work in USA per job requirements & payroll), I just want to know any criteria/conditions/restrictions if we have to stay 2-3 months out of USA Thanks again
