Hi,

 

I am currently on H4 dependent visa (wife on H1B), but my company is ready to get me L1 now. My question is should I be present in India to start or initiate L1 Visa or can I start L1 Visa process initiate from here and visit India only during Visa interview dates.

 

Please clarify and provide more info.

First check whether you are eligible for a L1 visa.

Your employer can apply for a change of status from H4 to L1 and on approval there is no need to go for visa stamping

A U.S. employer can file a change of status petition on behalf of an H-4 foreign national, assuming the individual qualifies for L-1 status. There is generally no need to go to a consulate until the individual wishes to leave the U.S. and then return in L-1 status.

But change in status from H4 to L1 doesn't valid with the below petition details. Kindly suggest.
