H1b - i140 date of birth mismatch

Hi

I have a mismatch of date of birth between my birth document and passport. Birth document is correct and based on that my i140 got filed and approved with the correct date of birth. I am currently trying to get my date of birth changed in passport to match with the birth document. However, my current i797- h1b approval (with the date of birth in the passport) is nearing expiration (6 years is getting over) and I need to apply for the new one soon. I will not get the passport fixed before that. Which date of birth will I use for the new i797? Can I use my date of birth in the passport this time too as I am scared of the current scrutiny on h1b applications.

Please advise me.
