H1 B Travel to India while transfer is in progress

Hi ,

 

I am planning to travel to India in November 1st week. My I-94 is on F1 and I got my H1B Approved with Employer A last year. Now I am planning to transfer my H1B to employer B which was filed last week. I wanted to know,

 

1. if I can travel to India while transfer is in progress.

 

2. If I can go for stamping on employer B  H1B , when it gets approved while I am in India.

What do you mean by saying your I94 is on F1? You say your are currently working with employer A on H1B and that means you need to have an I94 for H1B that is part of your I797A document. Do you have an I797A from employer A with I94?

Yes . I do have an I797 from employer A. But haven't traveled to India on it. My question now is,  I am in a process of transferring my H1B  with employer B. It might get approved any time when I am in India. Will it be ok to go for stamping on employer B's  H1B??

Yes, you can with all relevant documents for employer B
