ashes2010 Posted October 23, 2013 Report Posted October 23, 2013 Hello experts, Me and my wife had a recently visa stamped on h1 and h4. we have a baby born about 2 months and we have got his passport too. my son's passport family details: father :my name Mother my wife's married name i.e my name, my surname. my wife's passport family details ( before marriage passport) father: her father with different surname mother: her mother with her married name. I have started filling up ds 160 for my son and I have following questions. 1 ) my wife has a visa stamped on her passport with maiden name and she is still using the old name. when we applied for my son's passport we had chosen to put the mother's name as her married name. in short, my son's passport is having my wife's name as married name and we have not use her maiden name. now when it comes to DS 160 filling, what name I should put for my wife, married name ? which doesn't exist on the passport yet but my son's passport having that name. or my wife's maiden name ? in which she has a visa stamped. however, I am the principle applicant on h1 and not my wife. additionally, we have a marriage certificate too. Also, is it a better idea to have a new passport for my wife with married name before she lands to US? Thanks ashes2010

In your son's passport you need to change your wife's name to the one in her passport.

para1200 Posted October 24, 2013 Report Posted October 24, 2013 General rule for anyone: Stay consistent. It is not required that your last name and your wife's last name must be the same. We both had our own passports before marriage, but we decided right after marriage that she is going to change her name. We applied for new Indian passport for my wife using the marriage certificate and changed her maiden name to new name. For those who are planning to stick with the old name, you have to make sure it stays that way on marriage certificate, passports, even on your kids passport and any other places you can think of. In your case, for short while, it's just extra questions and answers all the time and proving she is the same person, based on her passport, marriage certificate, her name on your passport, but you are not doing anything wrong. You did not mention what is her name on the marriage certificate. I am assuming its her maiden name. Anyhow, marriage certificate is not an ID, so she will be only recognized by her name on her passport. Oh, do you know you can edit the DS-160? Use her name from her passport in this case. Long term, decide which name you want to go with across the board and start changing it in following places. 1. Her passport. 2. Your kids passport. 3, Marriage certificate. 4. On your passport (if you have spouse name on your passport). Some places are easier than others. I think, marriage certificate will the most difficult out of all, as it involves Indian government official. I would say run with your wife's name you have on your marriage certificate. Good luck.
