But I have not received a confirmation email from DOL and then Er Sponsorship confirm request email neither. However, the status of my Perm case is "In Process". Is it OK? or will be a problem?

Did you submitted or your employer?? Your post looks like you are taking care of everything from scratch. Anyhow, give some time to those poor guys.My guess is that because of shutdown their might be delays in processing.

But typically (at an average) how long does it take to get to the next step to file for I140 ? (Assuming the ETA 9089 gets certified).. Thank you !

And now a days the processing time is like 4-5 months. I guess you can check online which applications are currently being processed.

Here is my situation. My H1-B is expiring in July'15-2014 and max out- Extension Period (6 weeks remained on my H1-B). My PERM is filed on Sep'30-2013. Considering the timelines of 6-7 months of PERM processing, I am quite on the Border line. I may need to consider the timelines if any Audits happen on my case. Here is what all Options I can think of to be on the safer side. 1. Out of Country - for 3 Months, So that Extension (3 Months + 6 weeks) can be filed on my H1-B. What would be the best time to leave the country and re-enter before H1-B expires so that extension can be filed? Or this is not at a feasible Option. 2. Be in US and confident that you are on the safer side considering the timelines. 3. Any other suggestion or best options are most welcome. I really need help from you guys who may have been in similar situation. blancx Posted October 29, 2013 Report Posted October 29, 2013 You have 6 weeks of recapture time remaining. You need 5 weeks more (6 to be safe) to bridge the gap between July 16 and Sept 30. Discuss the situation with your employer. If your employer agrees, leave as soon as possible for 6 weeks. If you can work remotely, that will be beneficial. Return well before July 15, 2014 - some time by March/April. Apply for H1 extension till Sept 30. You may have to get it premium processed to get a result before Sept 30. After Sept 30 file for another H1 of 1 yr. Now, your employer may not like to file 2 H1's in one year. Second solution is - leave July 16 (as soon as possible after july 15). Apply for H1 extension for 1 yr plus the 6 weeks. Thus your start date can be 6 weeks before Sept 30. Discuss solutions with attorney.

I discussed my case with my Employer, They suggested to go to Canada and work for 6-8 week for the same client. I am planning somewhere in Mid Feb-14 and come back first week of April. My Only worried part is when I file for H1-B extension, is there any risk for filing H1-B extension for 12 week? What if my H1-B extension petition got rejected. is that going to impact my PERM processing. Should it be filed in premium? Thanks
Nikthakrar Posted May 12, 2017 Report Posted May 12, 2017 Hi, My lawyer has submitted ETA 9089 on 4th April 2017 and my employer didn't receive any email from DOL until End of April. AFter which my lawyer called DOL where they asked to send employer address and my client letters as a documentation. My lawyer faxed those docs on May 4. My attorney is not responding to my/employer's emails and my employer didn't receive any email yet. Should we keep waiting, is this normal? i am waiting to atleast get the priority date as i do not fall under the waiting game. Pls help.
