My company is planning to file my PERM, but i have less than 365 days before my H1B max out. I understand I should now have my PERM and I-140 Approved to continue my stay in US. Otherwise, I should stay out of country when my H1B Max out. Let's say my H1B will max out by Nov 1 2014 and my company files PERM by Dec 1 2013. In the worst case scenario, if I have an audit for my PERM, I will not have 365 days lead time for extending my H1B. In this case, can I take a 31 days vacation sometime in May 2014 so that I will have 31 more days before my H1B Max out? Also will this help to have 365 days lead time to apply for my H1B 1 Year Extension? Thanks,
