Is there a visa type for the partner that would grant work permit? Thank you! She can come on L2 visa which does not allow her to work. She can apply for EAD (Employment Authorization Document) after entering US and she can work as long as you maintain L1 status.

Attorney_23 Posted October 21, 2013 Report Posted October 21, 2013 Per 9 FAM 41.31 N14.4: "The B-2 classification is appropriate for aliens who are members of the household of another alien in long-term nonimmigrant status, but who are not eligible for derivative status under that alien's visa classification…Such aliens include, but are not limited to…cohabitating partners…If such individuals plan to stay in the United States for more than six months, they should be advised to ask the Department of Homeland Security (DHS) for a one-year stay at the time they apply for admission. If needed, they may thereafter apply for extensions of stay, in increments of up to six months, for the duration of the principal alien's nonimmigrant status in the United States."
catx Posted October 22, 2013 Report Posted October 22, 2013 Further, there is no work permitted or other employment authorization on a B-2 visa, which is a type of temporary visitors visa. The U.S. does not recognize cohabiting partners for derivative status and thus any associated employment authorization. (Even some derivative visas for a spouse such as H-4 do not allow work in the U.S.)
